AI liability does not depend on a single regulatory start date.

It arises from well-established principles of organisational responsibility:

The EU AI Act becomes generally applicable in August 2026.
This is legally correct – and strategically misleading.

From a governance and risk perspective:

  • The EU AI Act does not create liability
  • It codifies expectations that already exist
  • It formalises what organisations are already expected to manage

Liability does not emerge because a regulation applies.
It emerges when foreseeable risks are not governed.

AI is already foreseeable.
AI risks are already identifiable.
AI-related harm is already plausible.

Waiting for formal applicability is therefore a conscious risk decision.

In operational reality, unmanaged AI leads to:

  • material operational risk without clear ownership
  • model risk without validated controls
  • compliance risk without evidence
  • liability exposure without governance trail
  • accountability gaps across first and second line of defence

None of these risks begin in 2026.

They already exist wherever AI is used without a clearly defined governance structure.

When AI-related incidents occur, risk committees will not ask:

“Was the EU AI Act already applicable?”

They will ask:

“Why was this risk known, but not governed?”

From an Enterprise Risk Management perspective:

  • AI is already a risk driver
  • Lack of governance is already a control failure
  • Absence of documentation is already an accountability gap

AI liability therefore sits squarely within:

  • board oversight duties
  • risk committee responsibilities
  • organisational accountability frameworks

The real gap is not regulatory.
It is temporal.

AI adoption moves faster than:

  • risk classification
  • governance structures
  • control frameworks
  • auditability
  • documentation

This time gap is where liability crystallises.

Not because AI is illegal —
but because AI is unmanaged.

When AI-related decisions are challenged, organisations must be able to show:

  • that AI use was known and classified
  • that responsibilities were clearly assigned
  • that risks were identified and assessed
  • that controls were defined and implemented
  • that decisions were traceable and reviewable
  • that governance existed before incidents occurred

Governance is not paperwork.
It is evidence of responsible decision-making.

AI liability cannot be managed reactively.
It requires a systemic governance architecture that connects:

  • strategy and responsibility
  • risk identification and classification
  • operational controls
  • documentation and auditability

This is where AI governance becomes an operating capability, not a compliance afterthought.

If AI appears in your organisation before it appears in your governance and risk framework, you do not have an innovation problem.

You have a liability and accountability gap.

And that gap exists now – not in 2026.
